Transfer on Death Deeds
A transfer on death deed (TOD) is another way to pass your property to loved ones and avoid probate. TOD deeds are allowed in 27 other states but were not allowed in California until January of 2016. The TOD deed is beneficial because you can revoke your designation at any time, avoid probate, and your beneficiaries will get a step-up in basis upon your death. On the other hand, the TOD deed can only be used for a parcel with one to four residential dwelling units, condominium units, or not more than 40 acres of agricultural land with a single-family residence, the transfer is invalid if the beneficiary passes before the grantor, and the deed must be recorded within 60 days of signing.
